Terms and Conditions of Service
This document sets out the terms and conditions under which Emerge Energy provides its services. The principal terms outlined below apply once a customer uses the Emerge Energy switching or comparison service.

These terms and conditions govern the use of the services provided by Emerge Energy. It is important that you read them carefully before using our services. By using any Emerge Energy service, you confirm that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms, you must not use our services.
Price Comparison / Switching Service
Emerge Energy provides a price comparison and switching service to UK businesses. To be eligible to use this service, you must:
- Be a business resident in the United Kingdom
- Be eighteen (18) years or older (if operating as a sole trader)
- Meet the credit scoring requirements of any energy supplier (where applicable)
Emerge Energy reserves the right to refuse to provide services to any customer at its sole discretion.
Where a customer agrees to use our services, Emerge Energy will use reasonable endeavours to identify, negotiate, and secure competitive energy prices. Prices are sourced from a panel of energy suppliers using supplier-provided pricing information.
The customer agrees to provide Emerge Energy with accurate and complete information to enable accurate quotations to be obtained. This includes, but is not limited to, estimated or actual energy usage, contract end dates, and any other relevant factors that may influence pricing.
The provision of a quotation by a supplier via Emerge Energy does not constitute an offer. All offers are subject to the individual supplier’s terms, conditions, and acceptance criteria.
Once a customer accepts a quotation and a contract is executed between the customer and the supplier, the contract becomes legally binding and cannot be revoked by the customer.
Suppliers reserve the right to refuse acceptance of a customer’s offer at their discretion.
Where a customer and supplier wish to enter into a contract, Emerge Energy will provide a switching or renewal service, which includes facilitating the contractual process between the customer and the energy supplier for the supply of energy services.
Emerge Energy shall not be responsible for any delays or failures caused by the customer, the proposed supplier, or any existing supplier in connection with a transfer or renewal of supply.
Emerge Energy makes no guarantees regarding supplier service quality or the prices obtained at quotation stage. Energy prices fluctuate daily, and while we aim to secure competitive rates, we cannot guarantee that any quotation represents the lowest available price.
The customer acknowledges that it is their responsibility to verify the accuracy of any quotation provided.
The customer confirms that they are entering into a contract directly with the energy supplier and not with Emerge Energy. Emerge Energy shall not be liable for any dealings, contracts, transactions, or payment obligations between the customer and the supplier, all of which are undertaken at the customer’s own risk.
By using our services, the customer agrees that Emerge Energy acts as an independent energy brokerage and is not appointed as the customer’s agent or representative. Emerge Energy is not responsible for the delivery or performance of supplier services.
Charges
Emerge Energy is remunerated directly by energy suppliers and receives commission for securing and finalising contracts between customers and suppliers. This commission is typically included as an uplift within the unit cost of energy.
Accordingly, the cost of Emerge Energy’s services is incorporated into the energy contract agreed with the supplier.
For example, if Emerge Energy secures an electricity rate of 17 pence per kWh and applies a 0.5 pence uplift, the final contracted rate offered would be 17.5 pence per kWh. Commission is calculated as the uplift multiplied by the annual energy consumption and the contract duration.
Uplifts vary depending on contract size, duration, and factors such as credit risk. The average uplift typically represents a small percentage of the total energy cost and is commonly around 1 pence per kWh.
As Emerge Energy is paid by suppliers, we only offer prices from suppliers within our panel. Our supplier panel represents over 90% of UK business energy suppliers by customer numbers, ensuring a broad and competitive range of options.

Duplicate Contract Fees
Where a customer enters into a contract with a supplier using the Emerge Energy service, that contract is legally binding.
If the customer subsequently enters into another contract with a different supplier and the contract facilitated by Emerge Energy fails to proceed to live status, Emerge Energy will not receive payment from the supplier and will have incurred time and costs.
In such circumstances, Emerge Energy reserves the right to charge the customer a one-off failed contract fee of £150 per meter. This fee is in addition to any charges the supplier may seek to recover.
Customers are strongly advised to honour contracts once agreed and to avoid entering into duplicate contracts with multiple suppliers.
